Jessicas Voice

People are listening to my children!

People are listening to my children!

I hope everything works out favourably for Jessica.
My situation is different but falls under the Brussels II revised regulation aswell.
I am not allowed to comment on what is going on in the english court but I can comment on what is happening in France (please read my previous entry under 'my stories').
I was permitted to use the 'new' evidence provided by a recent CAFCASS report in the French court. The French court decided that the children's objections to being returned were so strong, that they were allowed to remain living in the UK with me.
The children are delighted and I am organising contact over the summer holidays with their father at the moment - as I have never wanted to stop them from seeing him.
My story hasn't quite reached its happy ending though. The case may be appealed in France again. I hope common sense prevails....

Over the past months, I have been fighting my fear of possible negative outcomes and concentrated on remaining positive. Sometimes, I have written down my wishes in a letter and then signed it. When I feel down, I read it again or write a new one. I have even pinned these 'positive' letters to the wall! Perhaps this might help someone else too!

These situations are very stressful and my children have suffered. In my case, they could have been saved the stress by listening to them, properly, early on.
The legal system is in a position to protect the welfare of children but it can also inflict tremendous psychological harm by ignoring the welfare question. The Convention on the Rights of the Child would prevent this if the Courts were brave enough to apply it in these international cases.
